Contract Conditions
You hereby certify that you are at least 18 years of age, and that you are renting the Soovu™ Pain Relief System shown on the checkout page from Soovu Labs, Inc. You also certify that you are the account holder of the debit or credit card used for the rental transaction shown on the order or that you are an authorized user who has been given permission by the account holder to use the card. Your completion of the rental transaction constitutes your acceptance of these terms defined herein.
Rental Periods and Rental Fees
Soovu Labs, Inc. offers two rental periods according to the following duration and fee schedule:
Extensions
We offer extensions in the following time frames: 1 month, 3 month, and 6 month. The cost to extend your rental is $99 per month. Contact help@soovu.com to extend your rental period.
Condition of Soovu Systems
Soovu Systems rented from Soovu Labs, Inc. are guaranteed to be correct according to your order, and in usable used or new condition. Soovu Systems will be shipped at Soovu Labs, Inc.'s discretion and depending upon supplier availability.
Shipping
Soovu Labs, Inc. relies on the expertise of our shipping provider United Parcel Service and/or FedEx to deliver your Soovu System(s) to you on time. Rare problems such as weather delays, rural routes, or shipping carrier system delays could affect the timing of your delivery. Standard shipping please allow up to 5 business days for processing and up to 14 business days for shipping. We are unable to ship to PO Boxes, Military Addresses, or outside the United States. We do not process orders on weekends or holidays.
Ownership
Soovu Pain Relief Systems (aka 'Soovu' and 'Soovu Systems') rented from Soovu Labs, Inc. are the property of Soovu Labs, Inc. At no time during the rental period does the renter obtain ownership of the Soovu Pain Relief System.
Communication
Soovu Labs, Inc. will send you notifications and order receipts to the email address(es) you have provided. Soovu Labs, Inc. may send you return notifications via email as a courtesy, but Soovu Labs, Inc. is not responsible to notify you in any way of the return due date. You are solely responsible for returning the Soovu System(s) by the due date whether or not you receive a reminder notification from Soovu Labs, Inc.
You authorize Soovu Labs, Inc. to send you emails and/or SMS text messages that include information about discounts, deals, products and services. You may unsubscribe from these communications at any time. Soovu Labs, Inc. may use information about you, including personal information and the information you provide for your rental transaction and/or online account creation to: (1) allow you to participate in features offered or to provide related customer service, such as responding to your questions, complaints or comments; (2) customize content recommendations and offers displayed to you; (3) process a transaction you initiate; (4) provide you with information, products or services; (5) send you special offers from Soovu Labs, Inc., its advertisers, or its third-party business partners; (6) process your registration for rental services, including verifying your e-mail address is active and valid; (7) improve the services and for internal business purposes; (8) contact you with regard to any use of the services and, in its discretion, make changes to policies; (9) Share your information with Soovu Labs, Inc. for purposes of collection; (10) for purposes disclosed at the time you provide your information or otherwise give your consent. Soovu Labs, Inc. will not ask you for any personal information, account username, and password, or any of your credit or debit card information via email or text message, and you will not provide such information via email or text message. Soovu Labs, Inc. will have no responsibility for any misuse of such information if you provide such information via email or text message.
Agreement to Return Soovu Pain Relief System
You agree to return the rented Soovu System in its original packaging or a suitable box to Soovu Labs, Inc. using the prepaid shipping label provided by Soovu Labs, Inc. within five (5) business days of the end of your rental period. Soovu System(s) that are not returned to Soovu Labs, Inc. will not be cleared from your account and you will continue to be responsible to pay rent until the Soovu System is returned to Soovu Labs, Inc. Please make sure you are using the Soovu System prepaid shipping label (provided by Soovu Labs, Inc.) to return all Soovu Systems.
Soovu Pain Relief System not Returned on Time
We will do our best to make returning your Soovu Pain Relief System simple and easy. As stated above, we provide a prepaid shipping label you can print. If however, the Soovu Pain Relief System is not returned within 5 business days of the end of the rental period, the following will occur: you will be notified via email that your card will be charged for a 1-month rental extension of the Soovu Pain Relief System. If the Soovu System is not returned within 5 business days of the end of the 1-month extension, you will be notified via email that your card will be charged for another 1 month rental extension of the Soovu Pain Relief System. If the Soovu System is not returned after two (2) 1-month extensions, Soovu Labs, Inc., at its sole discretion, may pursue charges and collections efforts including recovering its Soovu System or the value of the Soovu System. You hereby authorize Soovu Labs, Inc to charge your debit or credit card in the event of a late or unreturned Soovu System for rent using the 31 day extension rate set forth herein for each month that you fail to return the Soovu System and/or for the fair market value of the Soovu System. The fair market value of the Soovu System is determined to be the value of the Soovu System at the time it was initially rented; not the value at the time the card is charged.
Maintenance and Care of Soovu Pain Relief System
You, the renter, agree to keep the Soovu Pain Relief System in good, usable condition. Upon your receipt of the Soovu System and until you return the Soovu System to Soovu Labs, Inc., you are responsible for keeping the components in good working condition and to use only as directed by the instructions. In the event that any component of the Soovu System has been damaged by you due to abuse, misuse or alterations, you give authorization for Soovu Labs, Inc. to charge you the full fair market value of the Soovu System.
Right to Cancel Orders
Soovu Labs, Inc. retains the right to cancel or refuse any order that results from an error in pricing due to typographical errors, miscommunication with our partners, or any other incorrect information.
Refund and Return Policy

This Refund and Return Policy does not apply if the Soovu Pain Relief System has been damaged by you due to abuse, misuse or alteration.
Liability
Soovu Labs, Inc. shall not be held liable for any damages incurred, physical or emotional, tangible or intangible, for use of this rental.
Collections
You agree that you will not cancel or exceed the purchasing limits of the credit or debit card you provided until the rented Soovu Pain Relief System is either returned to Soovu Labs, Inc. or the non-return fees are paid. If the credit or debit card is declined, your account will be suspended and sent to Soovu Labs, Inc. for collection purposes. You authorize them to pass your information to any Third Party Collection Agency. You will be responsible for paying all reasonable fees, costs or collection fees assessed by Soovu Labs, Inc. or the Third Party Collection Agency.
Soovu Labs, Inc. will make reasonable efforts to process transactions in a timely manner and relies on Stripe, Inc. to process credit and debit transactions. You agree not to hold Soovu Labs, Inc responsible in the event Soovu Labs, Inc. does not credit or debit your credit or debit card for a period of time due to circumstances beyond its control. Soovu Labs, Inc. makes no guarantees regarding the processing time for charges.
In order for Soovu Labs, Inc. to service your account or to collect any amount you may owe, you agree, unless otherwise prohibited by applicable law, that Soovu Labs, Inc or a designated Third Party Collection Agency are authorized to (i) contact you by telephone at the telephone number(s) in the patron contact account information you are providing, including wireless telephone numbers, which could result in charges to you, (ii) contact you by sending text messages (message and data rates may apply) or emails, using any email address you provide and/or (iii) contact you using pre-recorded/artificial voice messages and/or use of an automatic dialing device, as applicable. You acknowledge that you have read this disclosure and agree that the Third Party Collection Agency may contact you as described above.
Except as otherwise provided herein, Soovu Labs, Inc agrees to keep all your personal and payment information confidential in accordance with our privacy policy.
Soovu Labs, Inc may assign this agreement to a parent or affiliate company at its sole discretion.
SOOVU LABS, INC. WILL REPAIR OR REPLACE ANY EQUIPMENT WHICH IS OR BECOMES DEFECTIVE UNDER NORMAL USE. SOOVU LABS, INC. WILL NOT BE LIABLE FOR INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR ANY OTHER DAMAGES RESULTING FROM DEFECTIVE EQUIPMENT; THEIR LIABILITY IS LIMITED TO REPAIR OR REPLACEMENT OF THE EQUIPMENT. THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED.
